(“AniForm”) located at aniform.com and aniformcloud.com (collectively referred to as the "Websites"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which details how we collect, use, and protect your personal information. If you do not agree to these Terms or the Privacy Policy, please do not use the Websites. The Privacy Policy is incorporated by reference into these Terms and is available at aniform.com/privacy.

All contents of the Websites, including texts, photographs, graphics, and other material, are either the property of AniForm or are used with permission from their respective owners. While access to and use of AniForm's software are governed by a separate licence agreement, we remind all visitors that “AniForm®” and other trademarks, as well as the software itself, remain the intellectual property of AniForm Engineering B.V. or their respective owners. Unauthorised use, reproduction, or modification of any trademarks, software, or content is strictly prohibited. AniForm Engineering B.V. reserves all rights not expressly granted in the licence agreement or elsewhere on the Websites.

The Websites may contain links to external websites not operated by us. AniForm is not responsible for the content or policies of these external websites. These links are provided for convenience and do not imply endorsement by AniForm.

5. Piracy Prevention

Software piracy involves the unauthorised possession, use, copying, or distribution of copyrighted software. When you purchase software, you are essentially buying a licence to use that software under specific terms, not the software itself. Engaging in unauthorised use, copying, downloading, sharing, selling, or installing the software onto personal or work computers without a valid licence is considered piracy. 6. User Accounts and Responsibilities

Users with an account on the Websites are responsible for maintaining the confidentiality of their account credentials, including their password. Users are responsible for all activities that occur under their account and agree to notify AniForm immediately of any unauthorised use or other security breach. Misuse of an account, including any actions that may harm AniForm or compromise the Websites' security or functionality, is prohibited. Any misuse of an account may result in immediate suspension or termination and may lead to further legal action if necessary.

7. Disclaimer of Warranties and Liability

The Websites are provided "as is" and without warranties of any kind, either express or implied. AniForm does not guarantee the accuracy, timeliness, or completeness of information on the Websites. To the fullest extent permitted by law, AniForm disclaims all liability for any damages arising from your use of the Websites or your inability to use the Websites, including but not limited to direct, indirect, incidental, and consequential damages.

9. Indemnification

Users agree to indemnify AniForm against any claims, damages, or costs arising from their use of the Websites or violation of these Terms.

10. No Waiver

No waiver by AniForm of any terms set out in these Terms shall be deemed a further or continuing waiver of such term or any other term.

11. Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions.

12. Governing Law and Disputes

These Terms of Use, and all legal relationships arising from or related to the Websites, including the licensing of software, are governed by the laws of the Netherlands. The United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (the “Vienna Sales Convention”) does not apply, irrespective of whether the licensing of software is categorised as a sale of goods or provision of services.

Any disputes arising between the Parties in connection with or as a result of these Terms of Use shall, in the first instance and at AniForm's option, be settled exclusively by arbitration or before the competent Court of Overijssel, located in Almelo, the Netherlands.
